Section A applies to all Visitors who accesses the Platform, whether or not they have created an account.

PART 1 -About the Website

About the Website

1. About the Platform

theresider.co is a B2C real estate marketplace and property market intelligence platform that enables Listing Members to advertise to Visitors. 

a. The Resider does not act as a real estate agent, broker, conveyancer, or legal advisor.

b. We do not represent buyers, sellers, landlords, or tenants in any transaction.

c. All property transactions are conducted solely between the relevant parties and are subject to applicable Barbados law, including the Conveyancing Act, Cap. 222, and the Real Estate Agents and Salesmen Act.

d. Listings on the Platform originate from two sources: (1) Listings Members for whom theresider.co produces all Multimedia Content; and (2) Listings Members who share their listing data with theresider.co under formal Data Sharing Agreements. In both cases, theresider.co is an advertising intermediary only.

2. Eligibility

The Platform may be browsed by any Visitor.

a. Certain features — including saving searches, submitting property enquiries, selling your homes — require registration as a Registered User (see Section B).

b. You must be at least 18 years of age to register or subscribe.

3. Accuracy of Information

a. Property listings details, pricing, availability — are provided by Members and are the sole responsibility of those Members. theresider.co does not independently verify the accuracy of any Listing.

b. Multimedia Content is provided for marketing purposes only.  including virtual tours and dynamic floor plans are visual representations and floor plans are approximate. Visitors are strongly advised to conduct in-person inspections and engage independent professional advisors before making any property decision.

c. Market Reports available on the Platform are derived from aggregated, anonymised listing data and are provided for general informational purposes only. They do not constitute financial, investment, legal or professional advice. theresider.co does not warrant the accuracy, completeness, or timeliness of any Market Report.

4. Intellectual Property

a. All Platform content not owned by Members — including the website design, layout, logos, software, editorial content, and Market Reports generated by theresider.co — is the exclusive property of theresider.co or its licensors and is protected by applicable intellectual property laws.

b. You may not reproduce, distribute, modify, or commercially exploit any Platform content without our prior written consent.

c. Multimedia Content is the intellectual property of theresider.co. Listing descriptions and data shared by Listings Members remain the intellectual property of those Members, subject to the licence granted to theresider.co under the Listing Member Terms.

5. Prohibited Conduct

a. Use the Platform for any unlawful purpose or in violation of applicable Barbados law.

b. Use automated tools, bots, or scrapers to extract data from the Platform without our prior written consent.

c. Reproduce, distribute, or commercially exploit any Listing, Market Report, or Platform content without written authorisation.

d. Attempt to gain unauthorised access to any account, system, or data on the Platform.

e. Submit false or misleading information when using any Platform feature.

f. Engage in any conduct that disrupts, damages, or impairs the Platform or other visitors’ experience.

g. Use content from the Platform to build, train, or improve any competing product, data service, or AI model without prior written consent.

6. Third-Party Links

theresider.co may contain links to third-party websites, mapping tools, or other features. These links are provided for convenience only. theresider.co has no control over and accepts no responsibility for the content or practices of any third-party site. Accessing third-party services is at your own risk.

7. Disclaimers and Limitation of Liability

a. The Platform and all content are provided on an “as is” and “as available” basis. To the fullest extent permitted by Barbados law, theresider.co disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

b. thersider.co shall not be liable for any direct, indirect, incidental, special, or consequential losses arising from: reliance on Listing information, Market Reports, virtual tours, or floor plans; property transactions entered into based on Platform content; Platform downtime or technical errors; or third-party content or services. Nothing in these Terms limits liability for fraud or any liability that cannot be excluded under Barbados law.

8. Governing Law

These Website Terms are governed by the laws of Barbados. Any dispute arising from your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Barbados.

 9. Amendments

theresider.co may update these Website Terms at any time. Updated Terms will be posted on the Platform with a revised effective date. Continued use of the Platform constitutes acceptance of any amendments.

PART 2 -Privacy Policy

Introduction

theresider.co is committed to protecting the privacy and personal data of all individuals who interact with our Platform.

This Privacy Policy explains how we collect, use, store, share, and protect personal information in connection with our real estate marketplace services, including multimedia property listings, virtual tours, dynamic floor plans, market reports, and our data-sharing arrangements with Listings Members.

This Policy complies with the Barbados Data Protection Act and the  [https://dpabarbados.com/]. 

By using the Platform in any capacity, you consent to the practices described in this Policy.

Data we collect

1. All Visitors

a. Technical data: IP address, browser type, device type, operating system, and session duration.

b. Usage data: pages visited, Listings viewed, virtual tours accessed, and floor plans interacted with.

c. Approximate location: derived from IP address for property search relevance.

d. Cookies and tracking data: as described in Section D.  

 2. Market Data

We process property listing data submitted by Listings Members under their Data Sharing Agreements.

a. This may include property addresses, prices, descriptions, and associated Multimedia Content.

b. Listing data is aggregated and anonymised for use in Market Reports.

How data is used

3. How We Use Your Information

a. Contractual necessity: to provide Platform services including account management, Listing hosting, Multimedia Content production, data ingestion, and Market Report access.

b. Legitimate interests: to generate Market Reports, improve Platform functionality, prevent fraud, and conduct analytics.

c. Consent: for marketing communications and non-essential cookies.

d. Legal obligation: to comply with applicable Barbados law.

e. To operate and manage visitors sessions and Registered User accounts..

f. To generate and publish Market Reports for Registered Users from aggregated, anonymised listing data.

g. To share enquiry contact details with relevant Listing Members when a Registered User submits a property enquiry.

h. To send transactional communications and, where consented, marketing communications.

i. To detect, prevent, and investigate fraud and security incidents.

j. To comply with legal obligations and respond to lawful requests from authorities.

Sharing of data

4. How We Share Data

We do not sell personal data. We may share information with:

a. Members: Registered members contact details are shared with the relevant users when a property enquiry is submitted by that user.

b. No personal data of visitors or Registered Users is shared without prior expressed consent.

c. Service providers: hosting, payment processing, analytics, email delivery, virtual tour technology, and floor plan rendering providers, under strict data processing agreements.

d. Legal authorities: where required by Barbados law or court order.

e. Business transfers: in connection with a merger or acquisition, subject to equivalent data protection obligations

Cookies

4. What Are Cookies

You may manage cookie preferences through our consent tool or your browser settings. Disabling certain cookies may affect Platform functionality.

a. Essential cookies: required for Platform operation. Cannot be disabled.

b. Analytics cookies: to understand how visitors interact with Listings, Market Reports, virtual tours, and floor plans.

c. Preference cookies: to remember search settings and location preferences.

d. Marketing cookies: where consented, to display relevant property content and advertisements.

Data retention

5. Data Retention

a. Visitor session and technical logs: up to 12 months.

b. Registered User account data: for the duration of the account plus 7 years.

c. Listing data (all plans): for the duration of the Listing plus 3 years for audit purposes.

d. Multimedia Content created by theresider.co is retained indefinitely as proprietary content.

e. Market Report source data: anonymised after 12 months; aggregated data retained for 5 years.

f. Enquiry and communication records: 3 years.

g. Member payment and billing records: 7 years (Barbados tax and financial regulations).

Security

6. Website Security

We implement TLS/SSL encryption, access controls, and regular security assessments to protect personal data.

Your rights

7. Consumer Data Protection

Under the Barbados Data Protection Act, Cap. 308D, you have rights of access, rectification, erasure, restriction, objection, data portability, and withdrawal of consent.

Submit requests to admin@theresider.co. We will respond within 30 days.

You may also lodge a complaint with the relevant Barbados data protection authority.

Amendments

8. Website Updates and Changes

We reserve the right to update this Policy at any time. Material changes will be notified to Registered Users and Members by email. Continued use of the Platform constitutes acceptance.

PART 3 -Fraud Prevention Policy

Purpose and Scope

theresider.co is committed to maintaining a safe and trustworthy real estate marketplace.

This Policy sets out our approach to identifying, preventing, and responding to fraudulent activity on the Platform, including listing fraud, data sharing fraud, identity fraud, payment fraud, and property transaction scams.

It applies to all visitors, Registered Users, Listing Members, and Partner Sites.

Types of Fraud We Address

1.1 Listing Fraud

a. Advertising properties that the Member does not own or have authority to let or sell.
b. Publishing intentionally misleading descriptions, photographs, virtual tours, or floor plans.
c. Duplicating legitimate listings to create fictitious alternatives at manipulated prices.
d. Advertising properties that are already sold, rented, or otherwise unavailable.
e. Using AI-generated or stolen imagery to fabricate property listings.

 

1.2 Data Sharing Fraud (Members Listings Plan)

a. Sharing fabricated, manipulated, or AI-generated listing data via a data feed or structured submission.
b. Deliberately restricting or distorting data shared with theresider.co to misrepresent available inventory or skew Market Report outputs.
c. Sharing listing data to which the Member does not hold the necessary rights or that was obtained through unlawful means.
d. Using the data-sharing arrangement to introduce malicious code, scripts, or harmful content into the Platform.

1.3 Identity and Account Fraud

a. Creating accounts using false names, stolen identities, or fictitious businesses.
b. Impersonating licensed real estate agents, brokers, or property developers.
c. Unauthorised access to another visitor’s, Registered User’s, or

   (c1) Use of multiple Members accounts to circumvent bans, inflate enquiries, or manipulate Market Report data.

1.4 Payment and Financial Fraud

a. Use of stolen or fraudulent payment instruments for Platform services.
b. Advance fee fraud: soliciting deposits or fees from Registered          c. Users as a condition of property viewings or rental approvals.
d. Money laundering through the creation of fictitious property transactions.
e. Fraudulent wire transfer requests referencing Platform listings.

1.5 Communication-Based Fraud

a. Phishing attempts impersonating theresider.co via email, SMS, or social media.
b. Redirecting visitors or Registered Users away from the Platform to conduct transactions through unmonitored channels.
c. Collecting personal or financial information from users under false pretences.

Our Fraud Prevention Measures

2.1 Member Verification

All Listing Members are required to complete our registration process, including identity verification and, where applicable, confirmation of real estate agent licensing and/or confirmation of authority to list each property.

2.2 Listing and Data Monitoring

We employ automated and manual review processes to detect suspicious Listings and anomalous data submissions. Listings or data feeds may be suspended pending review without prior notice.

2.3 Market Report Data Integrity

We apply data validation and outlier detection to all listing data used in Market Report generation. Data points that appear fabricated, duplicated, or statistically anomalous may be excluded from Market Reports without notification.

2.4 User Reporting

All visitors, Registered Users, and Members are encouraged to report suspected fraud to fraud@theresider.co.or via the “Report this Listing” function on any Listing page. Reports are treated confidentially and reviewed within 2 business days.

2.5 Payment Controls

All payments are processed through our PCI-DSS compliant payment gateway. Suspicious transactions may be declined or held pending verification. theresider.co will never request passwords, full card numbers, or advance payments via email or telephone.

Consequences of Fraudulent Activity

3.1 Action Against Fraud

Fraudulent activity may result in immediate account suspension or termination; removal of all Listings and revocation of data-sharing access; forfeiture of fees without refund; reporting to the Royal Barbados Police Force, the Financial Intelligence Unit of Barbados, or other relevant authorities; and civil action for recovery of losses. theresider.co cooperates fully with law enforcement investigations.

Protecting Yourself

4. Fraud Prevention Tips

  • – Never pay a deposit or transfer funds to a private individual based solely on a Platform listing without independently verifying the property and the identity of the seller or landlord.
  • – Always verify the Member’s real estate licence with the Barbados Estate Agents and Salesmen Licensing Authority.
  • – Be cautious of listings with unusually low prices or high-pressure timelines.
  • – Insist on an in-person or video-verified property viewing before committing to any agreement.
  • – Engage a qualified Barbados attorney for all property transactions and verify land ownership through the Barbados Land Registry before any purchase.
  • – Be suspicious of requests to communicate outside the Platform or to use cryptocurrency or overseas wire transfers.
